terms & conditions (terms of buisness)

  1. The vehicle is driven, tested (including road tests outside the workshop), repaired and stored at the sole risk, responsibility and liability of the customer. In case of damage due to an accident, repairs will be carried out at customers cost / under the insuarance of the vehicle.
  2. The Customer agrees to indemnify Kunal Motors against any risk, liability/responsibility for loss or damage to the vehicle and / or life or property of all persons arising out of repairing / servicing / test driving of the vehicle when the vehicle is in the Kunal Motors custody and the customer confirms to have obtained insuarance of the vehicle together with accessories and other components or articles and things therein and Kunal Motors hall not be liable for any loss, damages, injury whatsoever.
  3. The Customer will not hold dealer responsible / liable for any delay in delivery / in carrying out repairs/ in procurement of spare parts for reasons beyond Kunal Motors control.
  4. Customer is advised to remove any valuable items (cash, jwellery, etc.) at the time of handing over the Vehicle to the Kunal Motors. Kunal Motors will not be responsible for any valuable / article / item left in the car by the customer.
  5. The Customer undertakes to make payments of all charges before taking the delivery of the vehicle. Terms of payment are cash or demand draft only. Demand Draft Pay-Order should be made in favour of Kunal Motors & payble at Kanpur. If the bill settlement is delayed beyond a period of 7 days, Kunal Motors may charge interest @18% p.a on the outstanding bill amount from the date on which the vehicle was ready for delivery until the payment is made.
  6. The Customer undertakes totake the delivery of this vehicle within the 48 hours of advice from Kunal Motors regarding completion of the work after making payment towards repair charges including labour and cost of spare parts, if any.
  7. In the event of the Customer not taking the delivery of the Car from Kunal Motors workshop, the Customer has no objection to Kunal Motors levying storage charges Rs.250/- per day along with the charges towards repair, spare parts etc. from the date of Kunal Motors advice regarding completion of work till the date of Customer taking the physical delivery of the car.
  8. The Customer has no objection to Kunal Motors levying an estimation charge of Rs.500/- in case of repair or Rs. 10% of the total labour charges whichever is higher if the job is not entrusted to Kunal Motors obtaining the estimate. And the customer agrees to pay the same in addition to storage charge if any.
  9. The accidental repair estimate preperation charges for total loss of Hyundai car is Rs. 5,000 (five thousand only).
  10. Kunal Motors may exercise lien on the vehicle until all above mentioned dues are settled to Kunal Motors satisfaction.
  11. No vehicle will be delivered without the recipt.
  12. Kunal Motors may effect delivery of the vehicle to the person whose signature appears on the repair order form.
  13. Vehicles may not be delivered to the Customer after workshop closing hour, which is 5:00 PM.
  14. Salvage of accident repaired vehicles shall be taken by the customer at the time of taking the delivery of the car. Salvage not claimed/taken at the time of delivery will be disposed of by Kunal Motors as scrap.
  15. It may not be practically possible to check/record the working or availability or condition of various components, sub-assemblies, accessories etc. of the car. No responsibility whatsoever is taken by the workshop in this regard, and if any discrepancy is noticed during repairs, the remarks of the workshop in-charge will be final.
  16. It may not be practically possible to notice and record on the repair order all the dents, scratches-and damages etc, on the vehicle at the time of accepting the vehicle; and if some are noticed during repairs and servicing, the remark/decision of the workshop in-charge will be final.
  17. All disputes and differences arising from this repair order shall be setteled by mutual discussion andin case manually acceptable settlement is not arrived, any such dispute shall be subject to exclusive jurisdiction of court in Kanpur only.
  18. The Services & offer is subject to force majeure clause.
